In Manaus, STF Minister Luiz Fux highlights the importance of the work of notaries and recorders

MANAUS (AM) – The president of the Supreme Court (STF), Minister Luiz Fux, participated in the 7th Amazonian Meeting of Notaries and Recorders, this Friday, 13, in Manaus. On occasion, Fux highlighted that the work of notaries and recorders has an extensive capillarity and is important for de-judicialization, which is already exercised in other parts of the world.

“Notarial activity is as if it were a coexistent justice with traditional justice. In this historical moment, it assumes a very relevant and important role as we have, like many countries, the problem of judicial delay. Justice delayed is exactly an injustice of the system itself and the notary’s activity came to help us more and more with the amplitude of the notaries’ and registrars’ attributions”, he affirmed.

The minister praised the importance of the various activities performed by the notaries, such as, for example, the protest notary’s office, which enables faster collection and, consequently, is an obstacle to the crime of money laundering. Luiz Fux mentioned examples of the advancement of the decentralization of processes to the judicial system, such as the civil registries, which now register homoaffective unions and stable unions.

“It is no wonder that the Citizenship Office was created. To the point that in an outside-in view, a famous author, Mauro Cappelletti, affirmed that access to justice should not only be access to the judiciary, but an access beyond the courts, which comes exactly through the activities of the notaries of the extrajudicial forum,” he said.

Also in his speech, Fux emphasized the partnerships of the Brazilian Judiciary with the notarial activity and cited the several agreements that generate provisions. “The notarial activity has been a great partner of the judiciary. Our flag is Brazil. What is good for Brazil is good for us. The most important agreement we reached was between the National School of Magistrature and the School of Notaries and Recorders.

The Event

The solemnity was divided in several subjects, among them, the innovation of notarial and registral acts practice in electronic media during the Covid-19 pandemic, the new services of electronic authorization for minors’ trip, CPF emission in the act of birth registration, CNPJ at the moment of legal entities constitution, and the regularization projects of houses in the State of Amazonas. Fux spoke on the theme “Contemporary Notary: Rendering Notary and Registration Services”.

The event was attended by other authorities such as Mauro Campbell, from the Superior Court of Justice (STJ); Rebeca Mendonça, holder of the Children and Youth Court of the Amazonas Court of Justice (TJAM) and federal and state congressmen.
