MANAUS – The Superior Electoral Court (TSE) maintained, on Thursday, 7, the decision of the Regional Electoral Court of Amazonas (TRE-AM) to remove the mandate of the mayor of Coari, Adail Filho. Besides upholding the decision of the TRE last December, it was determined by the TSE, that new elections will be held in the city until the month of November.
After the ruling of the TRE-AM, Adail Filho filed an appeal with the TSE, however, during trial that began last Monday, 4, four of the seven ministers of the Court, voted against the appeal of Adail. It is worth mentioning that because of the request of Adail’s defense, the trial was postponed twice.
Family Base
Because of the family connection, the Electoral Court understood that Adail Filho could not be ahead of the mayor of the city of Coari, 363 km from Manaus, which would constitute a third consecutive mandate within the family unit. Adail and his vice-president Keitton Pinheiro were reelected in the first round of the 2020 municipal elections.
“He held the office of head of the Executive for more than two years, which characterizes a mandate for reelection purposes, regardless of the circumstances that led to his revocation”, said the minister Carlos Horbach, who even voted virtually for the holding of new elections.
Besides Horbach, the minister Sérgio Silveira Banhos also voted for the revocation of Adail Filho. The trial took place in Brasilia and was accompanied by the ministers Alexandre de Moraes and Edson Fachin. In December 2020, judges of the TRE-AM invalidated the candidacy registration of the then re-elected mayor Adail Filho.
At the time, the decision to bar the Pinheiro family “dynasty” was unanimous among the seven magistrates, being: Marcos Antônio Pinto, Victor Liuzze, Marcio Cavalcante, Sabino Marques, Gisele Pascarelli, Fabricio Marques and Aristóteles Thury.
Months after the invalidation, Adail’s defense appealed to the TRE- AM, but both the Court and the TSE denied the appeal request. Currently, by determination of the TRE itself, the city hall is under the directions of the president of the City Council of Coari, Dulce Menezes.
