BRASÍLIA (DF) – The Federal Senate approved on Tuesday, the PL 2.108/2021, which defines crimes against the Democratic State of Law, such as the interruption of elections and the use of fake news in the elections. The decision will repeal the National Security Law (LSN) of 1983. Now, the text will be sent to the President for presidential sanction, according to information from the Senate Agency.
The LSN was created during the military government and aimed to protect the integrity and national sovereignty. One example was that the law established that slander or defamation against the presidents of the Republic, the Supreme Court, the House of Representatives, and the Senate could result in a prison sentence of up to four years.
With the implementation of the 1988 Constitution, the text became obsolete, and its application was limited to cases involving the illegal introduction into the country of weapons that are exclusive to the Armed Forces. The LSN has 35 articles and was sanctioned by President João Figueiredo in 1983.
The LSN was used by the Jair Bolsonaro government to investigate opponents and also by the Supreme Court (STF) against Bolsonaristas. The project of law was approved, in May, by the House of Representatives – in its place, the congressmen created the so-called “Democratic State Law”.
