Servir Brasil and OAB point out ‘problems’ in the Administrative Reform

BRASILIA – The Parliamentary Mixed Front in Defense of the Public Service (Servir Brasil) and the Administrative Law Commission of the Brazilian Bar Association of the Federal District (OAB-DF) sent a technical note, on Wednesday, 22, to the members of the Special Commission that will define an opinion about the Proposal of Amendment to the Constitution (PEC 32/2020), of the Administrative Reform. The Commission must still meet on Wednesday, 22, to analyze the newest version of the opinion, the fourth to be presented, in an attempt to reach a consensus on the matter, by the reporter lawmaker Arthur Maia (DEM-BA).

The technical note presents a series of reservations and suggestions to the text of the substitute, in two versions presented previously, on September 16 and 17. According to the note, the documents reveal “serious problems of constitutional order with damages to the entire legal regime of the public servant and, consequently, to the adequate provision of public service”. The document was also prepared with the contribution of 26 representative entities of public service categories.

Improvements

The note lists a little more than 14 points considered problematic in the text of the PEC and concludes that the proposals still need to mature to ensure the legal security of those who will be affected by the change, since the measure intends to amend constitutional provisions.

The Proposal of Amendment to the Constitution has been receiving several criticisms from specialists and the public service, which evaluate several articles of PEC 32 as threats to the rights acquired by workers. Since last week, mobilizations have been taking place in Brasília and in other Brazilian cities to draw attention to the proposals presented in the PEC.

Eight opposition parties signed, on Tuesday, 21, a manifesto in which they commit to vote against the PEC 32 and mobilize even the governing parties to prevent the matter from being approved by the House.
