MANAUS – The minister of the Supreme Court (STF) André Mendonça was drawn rapporteur of the Direct Action of Unconstitutionality (ADI) filed by the governor of Amazonas, Wilson Lima (PSC), on Friday, 22. The ADI seeks to suspend the effects of Decree 11.047, signed by President Jair Bolsonaro (PL) on April 14, 2022.

The action was filed by the governor through the Attorney General of the State of Amazonas (PGE-AM) and requires the suspension of the reduction of the rates of the Tax on Industrialized Products (IPI) for products manufactured by industries located in the Manaus Free Trade Zone (ZFM), ensuring the competitiveness of the Industrial Pole of Manaus (PIM).

Wilson Lima announced the ADI through social networks, on Friday morning, but said he will maintain dialogue with the federal government to have all possible possibilities to reverse the current situation of the PIM.

In the text of the ADI, with 35 pages, the Government of Amazonas argued that the competitive advantages and differentials of the MFTz are amply supported in the Constitution of the Federative Republic of Brazil (CRFB) and charged that the STF recognizes the partial unconstitutionality of the decree signed by Bolsonaro.

André Mendonça is known for being a defender of Bolsonaro’s ideals. The minister has voted in favor of the Chief Executive’s decision on other occasions.
