The last straw: AM governor will trigger STF after Bolsonaro fails, again, promise on IPI

MANAUS – After President Bolsonaro (PL) failed, for the third time, to keep his promise to exceptionalize products from the Manaus Free Trade Zone (MFTZ) from the decree that promotes a 25% linear cut in the Industrialized Products Tax (IPI), the governor of Amazonas, Wilson Lima (União Brasil), said he will enter, still this Friday, 15, with a lawsuit of unconstitutionality in the Supreme Court (STF) to revoke the federal government’s decision.

“I am filing a lawsuit with the Supreme Court today to revoke this decision. The Manaus Free Trade Zone model is the most successful in the Amazon in terms of economic, social and environmental development. And my greatest concern is for the men and women who live in the State of Amazonas and who depend on these jobs to support their families,” declared the governor, in a video published on social networks.

The IPI reduction for the entire country compromises the competitiveness of the Industrial Pole of Manaus (PIM), which brings together about 500 industries and generates more than 100,000 direct jobs. In a statement, the Government of Amazonas said the Attorney General of the State (PGE-AM) is already with Adin ready to submit to the STF, asking for the revocation of the decree, in respect of constitutional guarantees of the ZFM.

Failure again!

The new Bolsonaro decree that changes the previous one was published in the Official Gazette of the Union (DOU) on the evening of Thursday, 14, on the eve of the Good Friday holiday. The changes start on May 1st of this year and do not depend on the approval of the Legislative.

According to the federal government, the measure seeks to adjust the rates of the Table of Incidence of the Tax on Industrialized Products (TIPI) for 2022, promoting maintenance of the general reduction of the IPI rate at 25% for most products.
