TJAM judge suspends teachers’ strike indicative in AM

MANAUS (AM) – The judge Domingos Jorge Chalub Pereira, the Court of Amazonas (TJAM), determined the suspension of the indicative strike of teachers of the state education network, scheduled to occur on Wednesday, 17. The decision was issued on the afternoon of Monday, 15, on an emergency basis, after the Public Civil Action filed by the State of Amazonas.

In the ruling, the magistrate notes that the assembly promoted by the Union of Education Workers of the State of Amazonas (Sinteam) “seems to lack legitimacy,” quality necessary to have the legality recognized. This is because, as reported in the decision, only a little over two thousand people, from the total of about 30 thousand members, attended the meeting that approved the strike, last day 11.

“Thus, I understand that, in light of the absence of robustness of the decision taken by assembly that did not count with even 10% (ten percent) of its members, should be granted the request for suspension of the indicative strike and the determination to refrain the defendant from adopting any measure that results in the paralysis of public services related to education”, says an excerpt from the decision.

The judge also established, the Sinteam, representative of the category, fine in the amount of R$ 30 thousand per day of downtime. “(…) In care of setting the fine, this should be established at a rate of R $ 30,000.00 (thirty thousand reais) per day of downtime, to fall only on the defendant Union and may not extend to servers that adhere to the illegal indicative.

In addition, the magistrate also determined that each day that the teachers who adhere to the strike stop working will be discounted from their salaries. “(…) I understand it is possible, once the illegality of the movement is verified, the discount in the payroll of the days that the education professionals stop working, as a direct result of safeguarding the public interest”.

Claims

On the last day 11, at an assembly held in Manaus downtown, Sinteam, during voting that included the participation of about 1,000 education professionals, approved the indicative strike of teachers of the state network, scheduled to begin on Wednesday, 17. Another 22 municipalities in the state also joined the movement.

The teachers are demanding a 25% salary readjustment, the payment of the base-date for the years 2022 and 2023, as well as retroactive payments for the years 2020 and 2021, and a health plan for retired professionals.
