‘We have to avoid this abuse of authority’, says miners’ leader after law that bans destruction is approved by ALE-RR

BOA VISTA – The leader of the movement “Garimpo é Legal” (‘Mining is Legal’ in english) in Roraima, Rodrigo Cataratas, told AMAZON AGENCY on Wednesday, 29, that the bill approved by the Legislative Assembly of Roraima (ALE-RR), which prohibits law enforcement agencies from destroying the property and assets of miners during inspections by state environmental control and inspection agencies, comes to prevent abuse of authority practiced in actions to combat illegal mining.

The statement is made one day after the ALE-RR unanimously approved the controversial bill. “We have to avoid this abuse of authority and avoid this truculence of the federal agencies against the citizen, because burning the citizen’s things without giving the right of defense, this is arbitrary and we are precisely fighting against this. So, for us, it is excellent”, said Rodrigo Cataratas.

Guarantee

According to the state lawmaker and author of the proposal George Melo (Podemos), the approval of the matter represents security to workers from various segments. According to him, it was a victory, a breakthrough, that the State of Roraima is providing.

“We made this law to guarantee not only the miner, but also the logger, the cattle rancher, the farmer to have his property, in case of some situation of seizure, that is safeguarded the right of this citizen to recover the property again, and not destroy, take a decree that was made in an indigenous area and bring it into the State of Roraima”, said Melo.

With 14 votes in favor, lawmakers approved the Bill No. 233/22, with amendments, presented by Lawmaker George Melo, on the prohibition of environmental inspection agencies and the Military Police to destroy and render useless private property seized in environmental operations/environmental inspections in the state.

“So, we have already talked and it was already approved, yesterday, by unanimity of those present. Because the technician and the bad professional want to damage the equipment. They will be held responsible from now on. So, this is an advance and a victory for democracy, and a victory for the people of Roraima who want to work so much. These hard-working people have the support, yes, of the public institutions when they see a project like this being approved”, he concluded.

Unconstitutional law

The Federal Public Ministry of Roraima (MPF) said in a statement on Tuesday, 28, that the law approved by the parliamentarians is unconstitutional, contradicts federal law and may contribute to the increase of environmental crime.

As pointed out by several precedents of the Supreme Court (STF), the state law can not undermine the procedure laid down in national legislation on the pretext of serving regional interest. For this reason, the Legislative Assembly of the State of Roraima (ALE-RR) incurs, once again, in flagrant unconstitutionality.

“Thus, the MPF understands that the proposal is clearly unconstitutional, decisively reduces the capacity of the State to combat environmental criminals and contributes lamentably to the ongoing humanitarian tragedy against the indigenous peoples. Finally, the agency states that it will opportunely adopt the appropriate measures, should Bill 233/2022 be sanctioned by the State Executive Power”, the note concludes.
